FinVista is a financial education and planning service provider. We act as an intermediary and advisor. We are not a bank, credit institution, or insurance company, unless explicitly stated in a separate service agreement.

• "Client" refers to a User who has signed a specific Service Agreement with FinVista for paid financial coaching or planning.

3. Eligibility

To use our Services, you must be at least 18 years of age or the legal age of majority in your jurisdiction. If you are using our Services on behalf of an entity, you represent that you have the authority to bind that entity to these Terms.

2. Services and Accounts

2.1 Service Description

FinVista provides budget allocation strategies, financial literacy coaching, debt management planning, and general investment education. Specific deliverables will be outlined in the Service Agreement signed by the Client. We strive to provide accurate and up-to-date information, but we do not warrant that the Website or Services will be uninterrupted, timely, secure, or error-free.

2.2 Account Creation

To access certain features, you may be required to register for an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security. We reserve the right to refuse service, terminate accounts, or remove or edit content at our sole discretion.

2.3 User Obligations

As a condition of using our Services, you agree not to:

7. Payments and Refunds

Our fees for specific services are listed on our website and will be confirmed in your Service Agreement. We reserve the right to change our fees at any time. Any changes will be effective immediately upon posting on the Website. However, fee changes will not affect Services already purchased.

7.2 Billing

Payments are due in advance for monthly, quarterly, or annual packages, as specified in the Service Agreement. For ongoing services, we will automatically bill your designated payment method on a recurring basis until you cancel your subscription.

7.3 Refunds

All fees are non-refundable except as required by law or at our sole discretion. If you are not satisfied with our services, please contact our support team. We may issue a pro-rated refund or credit for future services depending on the circumstances and the amount of work already completed. No refunds will be issued for services already rendered.

8. Termination

We may terminate or suspend your access to the Services immediately, without prior notice or liability, for any reason, including if you breach the Terms. Upon termination, your right to use the Service will immediately cease.

You may cancel your subscription or service agreement at any time by providing written notice to [email protected]. Cancellation will take effect at the end of the current billing cycle. No refunds will be issued for partial months or years.

9. Limitation of Liability

To the fullest extent permitted by law, FinVista, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers, or licensors shall not be liable for:

• Any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind including, without limitation, lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of the service or any products procured using the service.
• Any bugs, viruses, trojan horses, or the like that may be transmitted to or through our service by any third party.
• Any errors or omissions in any content or for any loss or damage of any kind incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available via the service.

Our aggregate liability shall not exceed the total amount of fees paid by you for the Services during the twelve months preceding the claim.

10. Indemnification

You agree to defend, indemnify, and hold harmless FinVista and our licensee and licensors, and our employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the service, by you or any person using your account and password; b) a breach of these terms; or c) Content posted on the service.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Germany, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email or by posting a notice on the Website prior to the effective date of the changes. Your continued use of the Services after the effective date constitutes your acceptance of the new Terms.
